Terms of Service

These Terms govern your access to and use of Yarneen AI (the “Service”), provided by Yarneen Digital LTD (“we”, “us”). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy.

1. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live if higher, to use the Service.

Keep your sign-in details secure; you are responsible for activity under your account. Tell us promptly about any unauthorised use. Information you give us must be accurate.

2. The Service

The Service lets you create AI Characters and generate images with them, train private models on images you provide, and — where enabled — plan and publish content to your own social accounts with Creator OS. Features differ by plan, some are offered in early access, and some may not be available to your account.

3. Creating AI Characters

Creating a character can involve these steps, depending on what is enabled for your account:

  • You describe the character with a prompt, or upload a reference image where that option is offered.
  • We generate candidate images; you choose one and lock it as the character’s identity (the “anchor”).
  • We generate reference images from the anchor, run automated quality checks, and may ask you to review them.
  • We train a character model (for example a LoRA) from the approved images and validate it automatically.
  • You generate new images (“Outputs”) of the character.

Each step is automated and results vary. We may combine your prompt with our own instructions before sending it to a model. A character can fail a quality check, and we may ask you to retry or stop a step that does not meet our checks.

4. Fictional characters and real people

Characters are intended to be fictional. You must not create, upload or generate a character or image that reproduces the likeness of a real, identifiable person — including public figures — unless it is you, or the person is an adult who has given you explicit permission and the feature you use allows it. You must not present a character as a real person in a way that misleads others, and you must follow the law and platform rules on labelling AI-generated content.

5. Your content and upload rights

“Your Content” means the prompts, text and images you provide. You must own Your Content or have every right and permission needed to use it with the Service, including the explicit consent of any identifiable adult shown in it. You confirm this each time you upload images of a person.

You give us a limited, non-exclusive, worldwide licence to host, copy, process and transmit Your Content and Outputs only to provide, secure and moderate the Service for you, including sending it to the providers listed in our Privacy Policy. This licence ends when the content is deleted, except for copies we must keep as described in the Privacy Policy. We do not use Your Content or Outputs to train AI models for other users or general-purpose models.

6. Prohibited use

You must not use the Service to create, upload, publish or distribute — or attempt to:

  • Content depicting, sexualising or exploiting minors, or any character that is or appears to be under 18.
  • Sexual, explicit or nude content, including non-consensual intimate imagery of anyone.
  • The likeness of a real person without their permission, impersonation, or a fake or deceptive identity used to mislead people.
  • Content that infringes copyright, trademarks, publicity or other rights.
  • Harassment, threats, hate, violent extremism, fraud, scams, or other illegal or harmful content.
  • Spam or manipulation of social platforms, or publishing that breaks a platform’s rules.
  • Circumventing moderation, safety filters, usage limits or credit charges; reverse engineering or scraping the Service; or accessing other users’ data.

7. Moderation and enforcement

We use automated checks that may block prompts or content, and we may review, block or remove content, stop a job, disconnect a social account, or suspend or terminate an account that violates these Terms. We may report illegal content to the relevant authorities. If you think we made a mistake, contact us.

8. AI outputs

Outputs are produced by machine-learning systems. They may be inaccurate, inconsistent, similar to outputs created for others, or unexpected, and a character may not look exactly the same in every image. You are responsible for reviewing Outputs before you use or publish them, and for how you use them.

9. Ownership

You keep ownership of Your Content. As between you and us, we do not claim ownership of your Outputs; your right to use them, including commercially, is subject to these Terms and to the features of your plan shown on our pricing page. AI-generated material may not be protected by copyright in some countries, and we cannot guarantee that Outputs are free of third-party rights.

The Service itself — its software, models we provide, design and brand — belongs to us or our licensors. These Terms do not give you any rights to it beyond using the Service.

10. Character models

A character model (such as LoRA weights) trained for your character is created and hosted by us, is used only to generate images for your account within the Service, and is not shared with other users. The Service does not currently offer downloading, exporting or transferring character models, and we do not guarantee that a character model will stay compatible with future base models. Character models are deleted when you delete the character or your account.

11. Credits, plans and payments

Use of the Service is measured in credits. Prices and credit amounts are shown on our pricing page and before you buy or start a job.

  • Credits have no cash value and cannot be transferred or exchanged for money. Unused credits are forfeited when your account is deleted.
  • Plan credits are granted each billing period, expire at the end of that period and do not roll over. Free-plan credits expire at the end of the month. Promotional credits expire as stated when granted. Credits bought in one-time packages do not expire while your account exists.
  • When a job starts, its credits are held. You are charged when the job succeeds. If a job fails or you cancel it, the held credits are returned automatically. Some jobs are charged per image actually delivered, and character builds follow the pricing shown before you start, including what happens if a build fails.
  • Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period and you keep access until then. Deleting your account cancels subscriptions immediately.
  • Payments are processed by Stripe. Taxes may apply as shown at checkout.
  • Payments are not refundable except where required by law or where we decide otherwise. To ask for a refund, contact us. If a payment is refunded, credits from it that you have not used are removed. Nothing in these Terms limits rights you have under consumer-protection law.

12. Creator OS and third-party platforms

Creator OS connects to social platforms only through their official APIs. You may connect only accounts you own or are authorised to manage. Instagram requires an Instagram Professional account (Business or Creator).

Instagram and other platforms are third-party services. Your use of them is governed by their own terms and policies (for Instagram, the Instagram Terms of Use and Community Guidelines), which you must follow. We are not affiliated with, endorsed by or sponsored by Meta or any other platform. Platforms may change or limit their APIs, reject or remove posts, or restrict accounts; we are not responsible for their actions, and we do not guarantee that any post will be published, published at a particular time, or remain online.

13. Publishing and your responsibility

You choose each creator’s approval mode: “I post myself”, “Publish what I approve”, or “Publish unless I object”. In the last mode, content that passes our automated checks is approved and published automatically unless you reject it before the cut-off (about one hour before its scheduled time). It is available only where your plan includes it, and only for creators you enable it for.

Everything published to your accounts through the Service — in any mode, including content approved automatically — is published on your behalf and is your responsibility. Review your schedule regularly. You can change the mode, cancel scheduled posts or disconnect an account at any time.

14. Disconnecting accounts

If you disconnect a social account, remove our app on the platform, or the platform revokes access, we delete the stored access tokens and cancel scheduled posts that were not yet published; nothing further will be published to that account until you reconnect. Posts already published stay on the platform until you remove them there. What we keep is described in our Privacy Policy.

15. Affiliate program

Participation in the affiliate program requires approval. Self-referrals and misleading promotion are not permitted, and commissions may be withheld or reversed in case of abuse or refunds.

16. Availability and changes to the Service

We work to keep the Service available but do not guarantee that it will be uninterrupted, error-free or always available. We may change, suspend or discontinue features, models or providers, for example for maintenance, safety, legal or cost reasons.

17. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service or others. Sections that by their nature should survive termination (such as ownership, disclaimers and limitation of liability) survive.

18. Disclaimers and limitation of liability

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind.

To the maximum extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law, or limits your statutory rights as a consumer.

19. Changes to these Terms

We may update these Terms. The version and date at the top show when they last changed. If changes are material, we will notify you and may ask you to accept the updated Terms before continuing to use the Service.

20. Governing law

These Terms are governed by the laws of the country in which Yarneen Digital LTD is registered, and its courts have jurisdiction, without depriving you of the protection of mandatory laws, or of the right to bring proceedings in the courts, of the country where you live as a consumer.
